Production company Good Morning To You is making a documentary about the song, which, as expected, will include the song itself reports Court House News Service . It claims it reluctantly paid Warner/Chappell’s demand for a $1,500 licensing fee, but was then served with a second letter warning that it could face a $150,000 statutory penalty for copyright infringement.
Good Morning to You seek a declaratory judgment that “Happy Birthday” is in the public domain, and financial compensation.
