A British woman was granted a spousal visa to be with her same-sex partner in Hong Kong, Jurist reports.
Her application was previously denied by the Hong Kong Immigration Department on the grounds that the term “spouse” didn’t apply to same-sex couples. However, she took her case to the Hong Kong High Court of Appeal and later won her case. Same-sex marriage is currently illegal in the country, but the couple was joined in a civil partnership in the UK in 2004.

Chief Judge Andrew Cheung explained his decision in a statement. “There is no inherent or otherwise necessary or obvious link between immigration and the status of marriage that requires exempting the differential treatment under a particular immigration policy of married same‑sex couples or couples under a civil partnership from the requirement of justification”.
